Terms of Service

1. Acceptance of Terms

By accessing or using Empire War ("the Game"), operated by Tuxxin ("we", "us", "our"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Game.

We reserve the right to modify these Terms at any time. Continued use of the Game after changes constitutes acceptance of the modified Terms. We will notify users of material changes via in-game notification.

2. Eligibility

You must be at least 13 years of age to use the Game. If you are under 18, you must have parental or guardian consent. Users in the European Economic Area (EEA) and United Kingdom must be at least 16 years of age, or have verifiable parental consent as required under the UK Age Appropriate Design Code and GDPR.

3. Account Registration

You must provide accurate, current information during registration. You are responsible for maintaining the confidentiality of your account credentials. One account per person. Creating multiple accounts to gain unfair advantage is prohibited and may result in permanent suspension of all accounts.

You may not sell, transfer, or share your account. Account sharing compromises security and may result in suspension.

4. Game Rules and Fair Play

The following activities are strictly prohibited:

  • Use of bots, scripts, macros, or automated tools
  • Exploiting bugs or glitches (report them to us instead)
  • Manipulating game mechanics through technical means
  • Harassment, threats, or abusive behavior toward other players
  • Impersonating other players or Tuxxin staff
  • Real-money trading (RMT) of in-game items, currency, or accounts
  • Intentional market manipulation through coordinated multi-accounting

We employ automated and manual anti-bot detection systems. Violations may result in temporary throttling, account flagging for review, or permanent suspension at our discretion.

5. Virtual Items and Currency

All in-game items, currency, divisions, employees, and other virtual goods are owned by Tuxxin and licensed to you for personal, non-commercial use only. Virtual items have no real-world monetary value and cannot be exchanged for real currency. We may modify, remove, or adjust virtual items at any time for game balance purposes.

6. Advertising and Third-Party Links

The Game displays advertisements through Google AdSense and contains affiliate links through Amazon Associates. We are not responsible for the content, accuracy, or practices of third-party advertisers or linked websites. Clicking affiliate links is entirely voluntary and provides small in-game rewards as disclosed in the Game.

7. Intellectual Property

All content in the Game, including but not limited to text, graphics, logos, game mechanics, code, and audio, is the property of Tuxxin and protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works based on any Game content without our prior written consent.

8. Limitation of Liability

The Game is provided "as is" and "as available" without warranties of any kind, express or implied. We do not guarantee uninterrupted or error-free service. In no event shall Tuxxin be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Game.

Our total liability shall not exceed the amount you have paid to us in the twelve (12) months preceding the claim, or $100, whichever is less.

9. Account Suspension and Termination

We may suspend or terminate your account at any time for violation of these Terms, suspicious activity, or any reason at our sole discretion. Upon termination, your license to use the Game is revoked and all virtual items are forfeited. We may, but are not obligated to, provide a warning before suspension.

10. Dispute Resolution

Any disputes arising from these Terms or the Game shall be resolved through binding arbitration, except where prohibited by law. For users in the United Kingdom and EEA, this does not affect your statutory rights under consumer protection legislation, including the right to bring claims in your local courts.

11. Governing Law

These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law principles. For users in the United Kingdom, the Consumer Rights Act 2015 and other applicable UK consumer protection laws apply where they provide greater protection.
